My Mountain Brook Experience - Poughkeepsie, NY

I've created this blog as a way of documenting my experiences at Mountain Brook Apartments as I seek to remedy an issue with a difficult neighbor. Should issues escalate without adequate response, I wanted a public record of all incidents.

This first email was sent at 3:11 a.m. on Tuesday, May 6, 2014:

I reside in Unit XX and moved in on March 24. I've been experiencing nuisance-level noise from my downstairs neighbor in XX for several weeks and the problem is quickly escalating.

His stereo system is frequently placed to a volume level in excess of 110 and even 120 decibels, usually between the hours of 5pm and 9pm. The noise causes my floor and living room walls to vibrate and essentially renders the apartment uninhabitable to me at that disturbingly loud noise level.

On Sunday, April 27 at 7:06 pm, I knocked on his door to request the stereo be turned down. After initially shutting the door in my face after briefly opening it, he eventually opened the door. I introduced myself as his upstairs neighbor and requested the stereo be turned down. He nodded and shut the door. The stereo was subsequently turned off 10 minutes later.

On Tuesday, March 5 at 8:15 pm, the stereo was again turned up to volumes in excess of 120 decibels (this is as high as the phone app I have can measure). This continued until 8:45 pm, when several guests arrived. The television and party remained at a fairly loud but tolerable level through midnight (60-80 decibels), with his guests shouting in and out of the apartment, and perhaps rendered more noticeable by the earlier occurrence. At 1:30 am I was awoken in the bedroom by his bedroom television turned onto a loud volume where it currently remains.

While I've experienced the issue with the incredibly loud stereo before, this is the first instance of such prolonged loud noise levels.

I wasn't able to find any sections in the lease addressing noise levels or quiet hours. But given that I just addressed the issue with my neighbor a week ago without satisfactory results, I was hoping the management association would be able to address this matter.

This issue is beginning to affect my health and well being, and I hope this quality of life issue can be resolved without incident.
